Agreement to these Terms
These Terms of Use are an agreement between you and Brainify SMC Limited (“Brainify,” “WearWise,” “we,” “us,” or “our”). They govern the WearWise iOS application, the WearWise website, and related accounts, content, subscriptions, and services together called the “Service.”
By downloading, accessing, purchasing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. By using WearWise, you represent that you meet these requirements.
If you use the Service on behalf of a company or other organization, you represent that you have authority to bind it to these Terms, and “you” includes that organization.
Accounts and guest access
You may be able to use limited guest functionality or create an account through Sign in with Apple or Google Sign-In. You agree to provide accurate information, protect access to your device and account, and promptly email wearwise@brainify.dev if you suspect unauthorized use.
Guest access is temporary. A guest workspace may expire after approximately 24 hours of inactivity, and guest data may then be deleted without recovery. Sign in when offered if you want eligible data to remain synced to a registered account.
You may not sell, rent, transfer, or share an account in a way that compromises security or permits unauthorized access. You are responsible for activity conducted through your account except to the extent caused by our failure to use reasonable security measures.
App license and Apple terms
The WearWise app is licensed, not sold. Subject to these Terms, Brainify grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the app on Apple-branded devices you own or control, as permitted by Apple’s Usage Rules, solely for your personal, non-commercial use of the Service.
Your license is also subject to Apple’s Licensed Application End User License Agreement (“Standard EULA”), incorporated by reference. The Standard EULA controls if it conflicts with these Terms on an app-license matter. These Terms control your WearWise account, subscription, user content, and online Service to the extent permitted by law.
Apple is not responsible for operating, maintaining, or supporting WearWise. Contact Brainify at wearwise@brainify.dev for product support.
What WearWise provides
WearWise provides wardrobe organization, garment and care-label analysis, outfit planning, generated imagery, weather- and occasion-aware suggestions, trip and packing tools, wear history, shopping assistance, and related features. Features may vary by account status, subscription, device, country, language, or availability.
Recommendations and generated content are for convenience and general information. They may be incomplete, inaccurate, unavailable, or unsuitable for your circumstances.
- AI output may contain errors or produce similar results for different users.
- Generated images may not exactly represent your clothing, body, fit, color, or final outfit.
- A garment’s original care label and manufacturer instructions take priority over WearWise analysis.
- Weather data and forecasts can change or be inaccurate.
- Product price, stock, sizing, quality, delivery, and returns are controlled by the retailer.
- WearWise is not professional fashion, tailoring, textile-care, medical, safety, financial, or legal advice.
Use your judgment and verify important information before acting on it.
AI-powered features
Some features use third-party AI services, currently including Google Gemini for garment, label, styling, and related analysis and OpenAI API services for generated look imagery. Relevant images, prompts, wardrobe attributes, and styling or planning context may be sent to those providers as described in our Privacy Policy.
Before WearWise first sends your personal data to a third-party AI provider, the app identifies the provider, explains what will be sent and why, and asks for permission. You do not have to consent, but features requiring that processing will not work without it. You may withdraw consent prospectively by stopping use of those features and emailing wearwise@brainify.dev.
You must not use an AI feature to create or process material that is illegal, harmful, deceptive, abusive, sexually exploitative, or that violates another person’s privacy, publicity, intellectual-property, or other rights.
AI output may not be unique. To the extent permitted by law and as between you and Brainify, you may use output generated specifically for you, but we do not promise that output is copyrightable, non-infringing, accurate, or suitable for commercial use.
Your content
“User Content” means photos, retailer links, wardrobe records, text, preferences, feedback, plans, and other material you submit to or create through the Service. You retain any ownership rights you have in your User Content.
You grant Brainify a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, transmit, and otherwise process User Content only as reasonably necessary to provide and personalize requested features; sync and display content; secure, maintain, troubleshoot, and improve the Service; comply with law; and enforce these Terms.
This license ends when the relevant User Content is deleted from active systems, except where continued retention is legally permitted or required or the content has been irreversibly de-identified. Brainify does not use User Content to train a Brainify-owned general-purpose AI model unless you separately and expressly opt in.
You represent that you have the rights and permissions necessary to submit User Content. Do not upload confidential material or images of another person unless you have authority and any required consent.
Acceptable use
You agree not to:
- violate law, these Terms, another person’s rights, or applicable third-party terms;
- upload unlawful, infringing, malicious, deceptive, abusive, exploitative, or privacy-invasive content;
- impersonate another person or misrepresent your affiliation;
- access or attempt to access another user’s account or non-public data;
- interfere with, overload, probe, scan, or bypass security, rate limits, subscriptions, or access restrictions;
- introduce malware or use automated tools to scrape, harvest, or extract the Service or its output at scale;
- reverse engineer, decompile, disassemble, or attempt to derive source code except where law expressly permits;
- resell, sublicense, or commercially exploit the Service without written permission; or
- use WearWise or its AI features to develop or train a competing model or service without written permission.
We may investigate suspected violations and suspend or terminate access where reasonably necessary to protect users, providers, Brainify, or the public.
WearWise+ subscriptions
Certain features require a paid, auto-renewable WearWise+ subscription purchased through Apple’s App Store. Available plans may include monthly and yearly periods. Before confirmation, the purchase screen shows the plan, period, localized price, included features, and any free-trial terms.
A WearWise+ subscription renews automatically for the same subscription period—monthly plans each month and yearly plans each year—until you cancel. Apple charges your Apple Account at confirmation and for each renewal at the price shown for your storefront, plus applicable tax. Apple may process the renewal charge during the 24 hours before the current period ends.
To prevent the next renewal, cancel at least 24 hours before the end of the current subscription or trial. If a free trial is offered and you do not cancel at least 24 hours before it ends, it automatically converts to the paid subscription at the full price displayed on the purchase screen.
Managing or cancelling
Manage or cancel through your Apple Account subscription settings or at apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current paid period, and you ordinarily keep access until then.
Deleting your WearWise account, signing out, or removing the app does not cancel your Apple subscription. You must cancel it separately through Apple.
Billing, restoration, and refunds
Apple processes billing, renewals, price-change notices, cancellations, and refunds under its terms and applicable law. Brainify does not receive your full payment-card details. Use Restore Purchases in the app to restore an eligible App Store purchase. Refund requests must be submitted to Apple unless law requires otherwise.
Prices and available plans may change. Apple handles required notice or consent for price changes to existing subscriptions. The price and terms shown by Apple at purchase or renewal control.
Retailers and affiliate links
WearWise may import information from retailer pages or recommend third-party products. Some links may be affiliate links, meaning Brainify may earn a commission if you purchase through them. Affiliate status does not change the price charged by the retailer.
Brainify is not the seller of third-party products and is not responsible for their content, stock, pricing, sizing, quality, shipping, returns, safety, or privacy practices. A retailer purchase is a separate transaction between you and that retailer.
WearWise intellectual property
Except for User Content and third-party material, the Service—including its software, design, branding, text, graphics, organization, and underlying technology—is owned by Brainify or its licensors and protected by intellectual-property law. No rights are granted except those expressly stated in these Terms.
WearWise, its logos, and related marks may not be used without prior written permission. Third-party names and marks belong to their respective owners.
Feedback
If you voluntarily provide ideas, suggestions, or feedback, you grant Brainify a perpetual, worldwide, non-exclusive, royalty-free right to use and incorporate that feedback without restriction or compensation. This does not give Brainify ownership of wardrobe photos or other User Content.
Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and delete personal data. Where consent is required—including for disclosed third-party AI processing—WearWise requests it separately.
Changes and availability
We may add, change, suspend, or discontinue features to maintain security, comply with law or provider requirements, improve the Service, or address technical and business needs. We will provide notice when law requires and will not deprive you of paid access without any remedy required by applicable law.
The Service may sometimes be unavailable because of maintenance, network failures, provider outages, emergencies, or events outside our reasonable control. We do not promise uninterrupted or error-free operation.
Suspension and termination
You may stop using WearWise at any time. Registered users can permanently delete an account through Profile → Account → Delete account. Account deletion removes eligible data as described in the Privacy Policy but does not cancel an Apple subscription.
We may restrict, suspend, or terminate access if you materially or repeatedly violate these Terms; create a security, legal, or safety risk; fail to pay an applicable charge; or if law or a service provider requires it. Where reasonable and legally required, we will give notice and an opportunity to correct the issue.
Sections that by their nature should survive termination—including ownership, payment obligations already incurred, disclaimers, liability limits, and dispute terms—will survive.
Disclaimers
Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
To the maximum extent permitted by law, the Service and all recommendations, generated content, retailer information, and third-party services are provided “as is” and “as available.” Brainify disclaims implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, secure, error-free, or that content will be accurate or meet your expectations.
Limitation of liability
Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, fraudulent misrepresentation, or other non-excludable liability.
To the maximum extent permitted by law, Brainify and its officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, opportunity, or data, arising from or related to the Service, even if advised that the loss was possible.
To the maximum extent permitted by law, Brainify’s aggregate liability arising from or related to the Service will not exceed the greater of the amount you paid for WearWise during the 12 months before the event giving rise to the claim or USD 50.
Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you.
Indemnity
To the extent permitted by law, you agree to indemnify and hold Brainify harmless from third-party claims, losses, and reasonable costs arising from your unlawful User Content, your material violation of these Terms, or your infringement of another person’s rights. This does not apply to the extent a claim results from Brainify’s own act or omission and does not limit non-waivable consumer rights.
Governing law and disputes
These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. Subject to mandatory consumer rights, courts of competent jurisdiction in Pakistan will have jurisdiction over disputes arising from these Terms or the Service.
If the law where you live gives you mandatory rights or permits a claim in local courts, this section does not take those rights away. Before filing a formal claim, you and Brainify agree to try in good faith to resolve the dispute by emailing wearwise@brainify.dev, unless urgent relief is reasonably necessary.
Changes to these Terms
We may update these Terms to reflect changes to the Service, providers, law, or security requirements. We will post the revised Terms with a new last-updated date and provide additional notice where required. If a material change requires consent, we will request it. Continued use after an effective update means you accept the updated Terms to the extent permitted by law.
General terms and contact
These Terms, the Privacy Policy, and the Apple Standard EULA are the entire agreement between you and Brainify concerning WearWise, except for additional terms clearly presented for a feature. If part of these Terms is unenforceable, it will be enforced to the maximum permissible extent and the remaining terms stay in effect. Failure to enforce a term is not a waiver.
